Terms of Service

1. Agreement to these terms

These Terms of Service govern your access to and use of Brandcell411 (the “Service”), an AI social content studio operated by Brandcell411 (“we”, “us”). By creating an account or using the Service you agree to these terms. If you are using Brandcell411 on behalf of an organization, you confirm you are authorized to bind that organization.

2. Accounts and eligibility

You need an account to use the Service. You are responsible for the accuracy of your account details, for keeping your sign-in credentials secure, and for all activity carried out under your account. Accounts are for identified users; do not share credentials with people outside your workspace.

3. Subscriptions, trials and billing

New accounts start with a 14-day free trial. After the trial you must select a paid plan to continue generating and publishing content. Paid plans renew automatically for the interval shown at checkout until cancelled. Plan limits — such as the number of brands, generations, and connected accounts — are shown in the app and may be enforced automatically.

You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and does not retroactively refund amounts already paid unless required by law.

4. Your content and your brands

You retain ownership of the websites, brand material, knowledge-base entries, drafts, and published posts you provide or generate through the Service (“Your Content”). You grant us a limited licence to store, process, and transmit Your Content solely to operate the Service on your behalf — including extracting brand kits, generating drafts and images, and publishing to social accounts you have connected.

You are responsible for ensuring you have the rights to any website, logo, imagery, or copy you submit for brand extraction.

5. AI-generated output

Brandcell411 uses AI models to generate text, images, and suggestions. Generated output can be inaccurate, biased, or unintentionally similar to other material, and identical or similar output may be produced for other customers. You are responsible for reviewing every draft before approving or publishing it. The approval queue exists for this purpose.

6. Connected social accounts

When you connect a social account, you authorize Brandcell411 to publish content and read basic account information on your behalf within the scopes you approve. Access tokens are encrypted before storage. You can disconnect an account at any time from the brand's Connections tab, which revokes our stored credentials for that account.

Your use of each social platform remains subject to that platform's own terms. We are not responsible for platform-side rate limits, rejections, account restrictions, or API changes.

7. Acceptable use

You agree not to use the Service to:

• Generate or publish unlawful, defamatory, harassing, hateful, or deceptive content.
• Impersonate a person, brand, or organization you are not authorized to represent.
• Produce spam, coordinated inauthentic activity, or content that violates a social platform's policies.
• Infringe intellectual property, privacy, or publicity rights.
• Reverse engineer, resell, or attempt to circumvent plan limits, rate limits, or security controls of the Service.

8. Service availability and changes

We work to keep the Service available, but it is provided on an “as is” and “as available” basis without warranties of any kind. Features, AI models, and third-party integrations may change, be deprecated, or become temporarily unavailable.

9. Suspension and termination

We may suspend or terminate access if you breach these terms, if your payment fails, or if required to protect the Service or other customers. You may stop using the Service and delete your account at any time. On termination we will delete or de-identify your data in line with the Privacy Policy.

10. Limitation of liability

To the maximum extent permitted by law, Brandcell411 is not liable for indirect, incidental, or consequential damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability arising from the Service is limited to the amounts you paid us in the twelve months preceding the claim.

11. Changes to these terms

We may update these terms as the Service evolves. Material changes will be announced in the app or by email before they take effect. Continued use after the effective date means you accept the updated terms.
